5 Can I delete my account?

You are free to discontinue use of the Website at any time by intimating us of your desire to do so by emailing us at support@beyondtime.in and we will strive to cancel your subscription and delete your account with us within 7 days of receiving such email. You agree and acknowledge that you will be deemed a subscriber to the Website and be bound by these Terms till we have completed your deregistration process and communicated to you the confirmation for the same.

Beyondtime.in is owned and operated by Galiakotwala Technologies Private Limited (hereinafter referred to as “GTPL”). Your use of beyondtime.in (hereinafter referred to as the “Website”), its subsidiaries, affiliates, licensors, associates and partners including (hereinafter collectively referred to as “Beyondtime”) is subject to these Terms of Use (hereinafter referred to as "Terms").

We reserve the right to alter or modify these Terms at any time without giving prior notice to you. Your use of the Website constitutes your unconditional acceptance of these Terms. We also reserve the right to post supplementary conditions for any Services that may be offered. In such an event, your use of those Services will be governed by these Terms as well as any such supplementary Terms that those Services may be subject to.

When you register with us, you must signify your acceptance of these Terms by checking the check box in the online registration form on the Website signifying your acceptance of these Terms. Pricing

We can only confirm the price of a product after you order. Such an event is probable due to possible typographical errors. If a product is listed at an incorrect price or with incorrect information on the Website due to an inadvertent mistake in pricing or product information, we shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product and notify you of such cancellation.

In the event that we accept your order the same shall be debited to your credit / debit card, net banking account and duly notified to you by email that the payment has been processed. If the same has been ordered through the Cash-on-delivery (COD) or Credit Card swiping on delivery mode, you undertake to pay on delivery of the product. In case of credit/debit card payments, if we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit / debit card account. The Price of a product and its availability are subject to change without notice.

 

Shipping and Delivery

You agree to and acknowledge the following shipping and delivery terms for products sold on the Website:

  1. Delivery/shipping is free within Mumbai city limits if your total order amount exceeds INR 100/-.
  2. All deliveries are done through either GTPL or GTPL approved reputed courier companies. For places not serviced by our approved courier companies, GTPL reserves the right to either refuse to accept the orders or make delivery through a mutually acceptable method after getting in touch with you. 
  3. On placement of the order, GTPL personnel may contact you to confirm the order.
  4. At the time of delivery, it is mandatory for the person accepting delivery to show an authentic photo identification proof. Subsequent to the delivery, the person accepting delivery is required to sign on the delivery challan/receipt, failing which the courier shall not give the delivery.
  5. All products available on the Website are insured against theft & damages until delivery. Once you have taken delivery of the product by signing on the delivery challan/receipt, you shall be deemed to have checked and accepted the product after which GTPL responsibility for the product ceases and the transit insurance expires.
  6. There are no additional charges other than the shipping charges and the price mentioned on the Website is inclusive of all taxes and levies unless otherwise specified.
  7. Delivery time depends upon the product ordered and may be variable depending upon the specific product ordered, the availability of that product and upon supply and logistics considerations. Estimated delivery time for a particular product is as specified in the product description of a particular product on the Website which maybe mentioned as:

Orders once placed are not cancellable. You undertake to purchase the product from the Website once you place an order for the same.

 

Disclaimer and Indemnification

GTPL expressly disclaims all warranties or conditions of any kind, express, implied or statutory, including without limitation the implied warranties of title, non - infringement, merchantability and fitness for a particular purpose.

You understand and acknowledge that the Website is merely a platform or an interface and nothing more. Therefore, your interactions and dealings with entities found on or through the Services, whether commercial or personal, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such entities. You should make whatever investigation or precaution you feel is necessary before proceeding with any online or offline transaction with any such entity.

You agree not to make GTPL responsible or liable for any loss or damage of any nature incurred as the result of such dealings. You understand and agree that we are under no obligation to become involved in the event of a dispute between subscribers on the Website, or between you and any third party.

You understand, acknowledge and agree that any product you may buy from the Website, whether within or after the warranty period, will be serviced at the manufacturer’s/ importer’s authorized service centre and we will not be liable in any manner for any service or fulfillment of warranty conditions for any product.

In the event of such a dispute with one or more other members, you hereby release GTPL, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed arising out of or in any way related to such disputes and / or the Services.

The Website and the Content present on it are provided strictly on “as is, where is” basis. We do not ensure or guarantee continuous, error-free, secure or virus-free operation of the Website or its Content including software, your account or continued operation or availability of any facility on the Website and that you voluntarily and with full knowledge risk such contingencies as aforesaid when you subscribe with the Website.

You agree that in the unlikely event of interruptions in the Services or your computer being affected by any viruses or computer contaminants from the Website, such outages would be with your permission and that you will not file any claims for compensation under any law for the same.

Additionally, GTPL does not promise or ensure that you will be able to access your account whenever you want. It is entirely possible that you may not be able to access your account or the Services provided by GTPL at times or for extended periods of time.

You agree to assume the whole and entire risk as to the results and performance of any Services availed by you on the Website as such result and performance among other things depends on your Internet connection. You also assume the entire cost of all servicing, repair and/or correction of your hardware when you access or download any information available on Beyondtime.in. GTPL expressly disclaims liability for any delay or failure for you to access the Website.

GTPL disclaims responsibility and liability for any harm resulting from suspension or deletion of your account due to any reason whatsoever.  You acknowledge and agree that you will not be entitled to any refund in case of any service outages that may be caused by periodic maintenance of our hardware or software, failures of its service providers, computer viruses or contaminants, natural disasters, war, civil disturbance, or any other cause beyond the reasonable control of GTPL

GTPL shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use the Website.

You agree to indemnify, defend and hold us harmless from all claims, damages and expenses made by any third party arising out of

  1. your content, or 
  2. your use of the Website, your connection to the Website, or
  3. your violation of these Terms or Privacy Policy; or
  4. use of the Website by any other person accessing the Services using your user name or password, whether or not with your authorization.

 

Dispute Resolution

Any dispute, controversy or claim arising out of the Terms or Privacy Policy shall be settled by a sole arbitrator appointed by GTPL in accordance with the provisions of the Arbitration & Conciliation Act, 1996 in force in India.

The place of arbitration shall be Mumbai and the language of arbitration shall be English. The applicable law shall be the laws of India and Maharashtra
